1. Acceptance of Terms

By accessing or using Happy Horse AI ("Service"), operated at happyhorseai.online, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you andHappy Horse AI.

2. Description of Service

Happy Horse AI is an AI-powered video generation platform that enables users to create short videos from text prompts (text-to-video) and/or reference images (image-to-video) using advanced AI models. The Service operates on a credit-based system where users purchase or receive credits to generate videos. Generated videos are stored on our servers and accessible through your account.

3. Account Requirements

  • You must be at least 13 years old to create an account and use the Service. If you are between 13 and 18, you must have parental or guardian consent.
  • You must provide accurate and complete information when creating an account.
  • You may sign in using Google OAuth or Magic Link email authentication.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • One person may not maintain more than one account.
  • You must promptly notify us if you become aware of any unauthorized use of your account.

4. Credits and Payment

4.1 Credit System

  • Video generation requires credits. Different AI models consume different amounts of credits per generation, as displayed on the pricing page.
  • New users may receive complimentary credits upon registration. These welcome credits are non-transferable and may have an expiration date.
  • Credits are frozen when a video generation task is initiated. If generation succeeds, the frozen credits are settled (consumed). If generation fails, credits are automatically released back to your account.
  • Credits are consumed on a first-in, first-out (FIFO) basis -- packages expiring soonest are consumed first.

4.2 Purchases and Pricing

  • Credits can be purchased through Creem, our authorized payment processor. All prices are displayed in USD unless otherwise stated.
  • Subscription plans provide recurring monthly credits and auto-renew unless cancelled before the renewal date.
  • One-time credit packages do not expire unless otherwise specified at the time of purchase.
  • Prices are subject to change. We will provide reasonable notice before any price increases take effect for active subscribers.

4.3 Refund Policy

  • Purchased credits are generally non-refundable once consumed for video generation.
  • If a technical issue on our end prevents video generation and credits are consumed without producing a result, please contact support for a credit restoration.
  • Subscription cancellations take effect at the end of the current billing period. No prorated refunds are provided for partial billing periods.
  • Refund requests for unused credits may be considered on a case-by-case basis within 14 days of purchase.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal under any applicable law or regulation.
  • Generate child sexual abuse material (CSAM) or any content depicting minors in sexual, suggestive, or exploitative contexts. Violations will result in immediate permanent account termination and will be reported to law enforcement.
  • Generate deepfakes or deceptive video content of real, identifiable persons without their explicit consent.
  • Generate content that promotes violence, terrorism, or hate speech targeting individuals or groups based on protected characteristics.
  • Generate content that infringes on any third party's intellectual property rights.
  • Generate sexually explicit, pornographic, or NSFW content.
  • Attempt to reverse-engineer, decompile, or extract the AI models or algorithms used by the Service.
  • Use automated means (bots, scrapers) to access the Service without our written permission.
  • Circumvent any credit system limitations, exploit bugs, or manipulate the system for unauthorized free generations.
  • Resell access to the Service or offer generated content as an automated service without our written permission.

We reserve the right to suspend or terminate accounts that violate these terms immediately and without prior notice or refund.

6. Content Moderation

We reserve the right to review, monitor, and moderate all content generated through the Service. We employ automated content safety filters to prevent the generation of prohibited content. Regarding enforcement:

  • We may remove or restrict access to any content that violates these Terms or our content policies, without prior notice.
  • We may immediately suspend or permanently terminate your account for content policy violations.
  • All remaining credits will be forfeited upon termination for policy violations, with no refund.
  • We may report illegal content to the appropriate law enforcement authorities and retain evidence as required by law.
  • Attempts to circumvent, disable, or bypass our content safety filters constitute a severe violation and will result in immediate account termination.

7. Intellectual Property

7.1 Your Content

  • You retain ownership of the text prompts and images you upload to the Service.
  • You grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (generating and delivering your videos).

7.2 Generated Videos

  • Subject to compliance with these Terms, you may use AI-generated videos for both personal and commercial purposes.
  • We do not claim ownership of the videos generated through your use of the Service.
  • You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions.
  • You are solely responsible for ensuring your use of generated content complies with applicable laws and does not infringe third-party rights.

7.3 Platform License

You grant us a non-exclusive, royalty-free license to host, store, and deliver your generated videos through our infrastructure (including Cloudflare R2 storage and CDN) for the purpose of providing the Service to you. This license exists solely to enable us to technically deliver the Service and does not grant us rights to use your content for any other purpose.

7.4 Our Property

The Service, including its design, logos, software, and documentation, is owned by Happy Horse AI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Service Availability

  • We strive to provide reliable service but do not guarantee uninterrupted or error-free availability.
  • The Service depends on third-party AI providers, and generation times, quality, and availability may vary.
  • We may perform scheduled maintenance that temporarily affects service availability.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time, including changes to pricing, credit costs, available AI models, and features.
  • We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. AI-Generated Content Disclaimer

  • AI-generated videos are produced by third-party AI models. We do not guarantee specific output quality, accuracy, or consistency.
  • Generation results may vary based on the AI model selected, prompt quality, and other factors beyond our control.
  • We are not responsible for any unintended, offensive, or inappropriate content produced by AI models despite our safety filters.
  • Generation times are estimates and are not guaranteed.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPY HORSE AI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Account Termination

  • You may request deletion of your account at any time by contacting us at contact@happyhorseai.online.
  • We may suspend or terminate your account immediately if you violate these Terms, with or without prior notice.
  • Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited.
  • We may retain certain data after termination as required by law or for legitimate business purposes (e.g., transaction records for accounting compliance).
  • Upon account deletion, your generated videos will be permanently removed from our storage.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is established, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of that jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. For significant changes affecting your rights, we will make reasonable efforts to provide advance notice.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.
